Terms of Service

1. Who you are contracting with
The Getit concierge service ("Getit", "we", "our", "us") is operated by Goncalo Vardasca Fonseca, an independent sole proprietor ("Seller"). By creating an account or using the service you ("user", "you") enter into a binding agreement with the Seller on these Terms.
2. Acceptance & authority
By signing up, accessing, or continuing to use Getit you agree to these Terms and our Privacy Notice. You confirm you are at least 18 years old (or the age of majority in your jurisdiction) and, if acting on behalf of an organisation, that you have authority to bind it.
3. The service
Getit is a digital concierge platform that connects members with human concierges to arrange travel, dining, experiences, gifting, and similar lifestyle services. Concierge arrangements may involve third-party suppliers; we are not the seller of those goods or experiences and do not guarantee availability, pricing, or fulfilment by external partners.
4. Account & accuracy
You must provide accurate information, keep it up to date, and maintain the confidentiality of your credentials. You are responsible for all activity under your account. Notify us immediately at info@getitapp.online if you suspect unauthorised use.
5. Acceptable use
You must not misuse the service. In particular, you must not:
- use Getit for any unlawful, fraudulent, or deceptive purpose;
- send spam, malware, or attempt to probe, scan, or breach security;
- scrape, reverse engineer, or circumvent technical limits;
- infringe intellectual property or privacy rights of any third party;
- resell, sublicense, or redistribute the service or its outputs.
6. Intellectual property
Getit, including its software, design, branding, copy, and proprietary workflows, is and remains the exclusive property of the Seller. You receive a limited, non-exclusive, non-transferable, revocable licence to use the service for personal, non-commercial purposes within the plan you have subscribed to. No other rights are granted.
7. User content
You retain ownership of any content you submit (preferences, messages, briefs). You grant us a limited, worldwide, royalty-free licence to host, store, process, and transmit that content solely to operate, improve, and provide the service to you.
8. Payments, subscriptions, taxes & refunds
Payments are processed by Stripe Payments Europe, Ltd. Card details are handled directly by Stripe and are never stored on our servers. Applicable taxes (VAT, GST, sales tax) are calculated, collected, and remitted automatically at checkout based on your billing location, in accordance with Stripe's Services Agreement.
Subscriptions renew automatically at the end of each billing period until cancelled. You may cancel at any time from the membership screen and retain access until the end of the paid period. Refund requests are handled directly by us — see our Refund Policy.
9. Service availability & warranties
The service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, error-free, or secure operation. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
10. Liability
To the fullest extent permitted by law, our aggregate liability for any claim arising out of or related to the service is limited to the fees you paid us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special, incidental, or punitive damages, including loss of profits, data, goodwill, or substitute services. Nothing in these Terms limits liability for fraud, gross negligence, death, or personal injury where such limitation is prohibited by law.
11. Indemnity
You will indemnify and hold harmless the Seller from claims, damages, and reasonable legal costs arising out of your user content, your unlawful use of the service, or your breach of these Terms.
12. Suspension & termination
We may suspend or terminate your access, in whole or in part, if:
- you materially breach these Terms or our acceptable use rules;
- a payment fails or is reversed and is not promptly resolved;
- we reasonably suspect fraud, abuse, or a security risk to the service or others;
- continued provision would violate applicable law or partner policies.
You may terminate at any time by cancelling your subscription and closing your account. On termination, your licence ends; we will delete or anonymise your data subject to the retention rules in the Privacy Notice.
13. Changes to the service or Terms
We may update the service and these Terms from time to time. Material changes will be notified by email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
14. Governing law & disputes
These Terms are governed by the laws of Portugal, excluding its conflict-of-laws rules. The courts of Lisbon, Portugal have exclusive jurisdiction, subject to any mandatory consumer rights you have in your country of residence.
